Agreement to these terms

These Terms of Service ("Terms") govern your use of the Loana mobile app and website (the "Service"), provided by Hendrix Consulting LLC ("Loana," "we," "us"). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.

What Loana is

Loana is an educational tool that helps Vietnamese learners improve their English pronunciation by practicing full sentences and receiving feedback. Loana is a practice aid, not a certification, exam, or guarantee of any particular result.

Who can use Loana

You must be at least 13 years old to use Loana. By using the Service, you confirm that you are 13 or older. Loana is not directed to children under 13.

Accounts

No account is required to use Loana today. If we introduce optional accounts in the future, for example to save your progress across devices, additional terms may apply and we will make them available at that time.

Acceptable use

You agree to use Loana only for lawful, personal, educational purposes. You agree not to:

• misuse, disrupt, or attempt to gain unauthorized access to the Service or its systems;
• copy, resell, or commercially exploit the Service or its content without our permission;
• upload content that is unlawful, infringing, or that you do not have the right to record;
• use the Service to violate the rights of others.

Your recordings and content

You keep ownership of the recordings you make. To provide the Service, you grant us a limited license to process your recordings and practice data solely to analyze your speech and give you feedback, and to operate and improve the Service, as described in our Privacy Policy. We do not sell your recordings.

Our content and intellectual property

The Loana app, website, name, logo, design, practice content, and software are owned by Hendrix Consulting LLC and protected by intellectual property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose. All rights not expressly granted are reserved.

Fees

Loana is currently provided free of charge. We may introduce paid features or plans in the future. If we do, we will disclose the pricing and terms before you are charged, and any paid features will be optional.

Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind. Pronunciation feedback is generated automatically and may not be perfect; it is for learning purposes and should not be relied on as professional, academic, or certified assessment. We do not warrant that the Service will be uninterrupted, error-free, or meet your specific goals.

Limitation of liability

To the fullest extent permitted by law, Hendrix Consulting LLC will not be liable for any indirect, incidental, special, or consequential damages, or for any loss arising from your use of, or inability to use, the Service. Some jurisdictions do not allow certain limitations, so some of these may not apply to you.

Changes to the Service and these Terms

We may change, suspend, or discontinue the Service, in whole or in part, at any time. We may also update these Terms as Loana evolves; when we do, we will revise the "Last updated" date above. Your continued use of the Service after changes take effect means you accept the updated Terms.

Governing law

These Terms are governed by the laws of the United States and the state in which Hendrix Consulting LLC is organized, without regard to conflict-of-laws rules, except where local law requires otherwise.
